Terms of Service

By downloading, installing, or using LMInsta (“the Software”), or by creating an account on this website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Software or this website.

Subject to your payment of the applicable subscription fee and compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, limited license to install and use the LMInsta desktop application on up to two (2) devices that you own or control.

This license does not permit you to: sublicense, resell, distribute, or share access to the Software; reverse engineer, decompile, or disassemble the Software; use the Software to build a competing product.

3.1 Billing

LMInsta is offered on a subscription basis (monthly or yearly). Subscriptions are billed in advance and renew automatically until cancelled. Prices are displayed at checkout and on the Pricing page.

3.2 Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for the remaining portion of a billing period.

3.3 Refunds

If you experience a technical issue that prevents you from using the Software and we are unable to resolve it within 7 days of your report, you may request a refund within 14 days of your purchase. Refund requests are evaluated on a case-by-case basis.

Each license may be activated on up to two (2) devices simultaneously. If you need to transfer a license to a new device, you must deactivate it from an existing device via your dashboard or by contacting support.

LMInsta uses the official Instagram API with Instagram Login to interact with Instagram on your behalf. By using LMInsta, you agree to comply with Instagram’s Terms of Use and Meta’s Platform Terms. You are solely responsible for the content you publish through LMInsta and for ensuring it complies with Instagram's community guidelines.

You agree not to use LMInsta to:

• Violate any applicable law or regulation, or Instagram's platform policies.
• Publish spam, misleading information, or content that infringes third-party intellectual property rights.
• Attempt to circumvent Instagram's rate limits or automate actions in a way that violates Instagram's Terms.
• Use the Software in any way that could damage, disable, or impair our servers or services.

We reserve the right to revoke your license without refund if we determine your use violates these Terms or Instagram's policies.

LMInsta and all associated materials are the intellectual property of LMInsta and its licensors. These Terms do not grant you any rights to our trademarks, service marks, or logos.

Content you create using LMInsta (captions, images, etc.) remains your property. We claim no ownership over content generated by or for you.

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

WE ARE NOT RESPONSIBLE FOR ANY ACTIONS TAKEN ON YOUR INSTAGRAM ACCOUNT AS A RESULT OF USING LMINSTA, INCLUDING ACCOUNT SUSPENSION, CONTENT REMOVAL, REDUCED REACH, OR ANY OTHER CONSEQUENCE IMPOSED BY INSTAGRAM OR META. YOUR USE OF THE SOFTWARE IS ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LMINSTA, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND — INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO:

• Your use of or inability to use the Software;
• Any content you create, publish, or distribute through the Software;
• Any actions taken by Instagram, Meta, or any third-party platform in response to your use of the Software;
• Any unauthorized access to or alteration of your transmissions or data;
• Any bugs, viruses, or other harmful code transmitted through the Software by any third party.

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

BY USING LMINSTA YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT LMINSTA SHALL NOT BE HELD RESPONSIBLE OR LIABLE FOR ANY ISSUE THAT MAY ARISE FROM YOUR USE OF THE SERVICE.

We may suspend or terminate your license if you materially breach these Terms and fail to cure the breach within 5 business days of written notice. Upon termination, you must cease all use of the Software and delete all copies.

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts applicable to the registered location of LMInsta.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the website. Continued use of the Software after the effective date of revised Terms constitutes your acceptance.
